Documents for Registration of PIBOs– Plastic Waste Management (Amendment) Rules, 2022

Plastic Waste Management (Amendment) Rules, 2022 were notified by the Ministry of Environment, Forest, and Climate Change (MoEFCC) on 16 February, 2022.
Key points of these Rules are as follows;

• Mandates the producer/importer/brand owner to register through the online EPR portal of CPCB as Producer/ Brand owner/ Importer entity.

• Provides EPR targets which a producer/importer/brand owner must meet in order to fulfill its obligations.

• EPR shall be applicable to both pre-consumer & post-consumer plastic packaging waste.

• Brand owners (BOs) in Micro & Small Category are exempted from EPR Registration.

• PIBOs are provided with targets for ‘minimum level of recycling of plastic packaging waste’, starting from year 2024-25 (Ref: section 7.2(b) of the said amendment rules, 2022 for producers, section 7.3(b) for the importers and section 7.4(c) for the brand owners).

• PIBOs are provided with targets for ‘use of recycled plastic content in the plastic packaging’, starting from year 2025-26 (Ref: section 7.2(d) of the said amendment rules, 2022 for producers, section 7.3(d) for the importers and section 7.4(e) for the brand owners).

Plastic Waste (Management) Rules, 2022 define Producers, Importer and Brand owner as follows;

a) Producer –

Any person or entity who engages in manufacture or import of carry bags or multilayered packaging or plastic sheets or like, and includes industries or individuals using plastic sheets or like or covers made of plastic sheets or multilayered packaging for packaging or wrapping the commodity.

b) Importer –

Any person who imports plastic packaging product or products with plastic packaging or carry bags or multilayered packaging or plastic sheets or like.

c) Brand Owner –

Any person or company who sells any commodity under a registered brand label/trademark.
