In this article, we list down the documents required for the registration of Producers with EPR portal of Central Pollution Control Board (CPCB) under Schedule IX of Hazardous and other Waste (Management and Transboundary Movement) Amendment Rules, 2022.

1. Draft Notification on EPR for Waste Tyre

• MoEFCC has notified the Hazardous and Other Wastes (Management and Transboundary Movement) Amendment Rules, 2022 on 21st July, 2022.

• There are provisions for the management of waste tyres through the regime of Extended Producer responsibility (EPR) as per schedule-IX of these rules.

• As per the said rules, Waste tyre is defined as “Any tyre, including tubes and flaps, that is no longer mounted on a vehicle and is no longer used for its intended purpose”.

• These rules mandate the producer/recycler/retreader to register on the online portal of CPCB.

• These rules introduce EPR obligations for the producers to ensure ‘Environmentally Sound Management’ of waste tyres.

2. Who are Producers?

As per the said rules, a producer is defined as

• An entity which manufactures and sells new tyre domestically;

• An entity which sells domestically under its own brand, new tyre manufactured by other manufacturers or suppliers;

• An entity which sells imported new tyre;

• An entity which imports vehicles fitted with new tyres;

• Automobile manufacturers importing new tyre for use in new vehicles sold domestically;

• An entity which imports waste tyre.
